Jack Smith Brings New Charges Against Trump After Supreme Court Ruling

WASHINGTON, D.C. — Following last month’s Supreme Court decision on presidential immunity, Special Council Jack Smith has filed new charges against former President Donald Trump in federal court.

The updated lawsuit still includes four counts related to Trump’s alleged attempts to stay in power after losing the 2020 election. In this post, we explain what’s in the new charges and what they mean for the ongoing case.

Strengthening the Case

Supreme Court’s recent decision forced the Special Council to make big changes to his case against Trump. “Last month, they removed a large part of the Special Council’s case against Donald Trump,” she said.

Smith responded by adjusting his case to fit the Supreme Court’s guidelines better.

Main Changes in the Charges

The new charges are now 36 pages long, down from 45. The biggest changes reflect the Supreme Court’s emphasis on presidential powers when dealing with the Justice Department.

“The main change is that the Supreme Court told the Special Prosecutor last month that the President has a lot of power when it comes to working with the Justice Department.”

As a result, Smith removed claims that Trump had pressured Justice Department officials with false statements about voter and election fraud.

Also, one alleged co-conspirator, thought to be Jeffrey Clark, has been removed from the charges. Clark, who Trump promoted in the Justice Department just before January 6th, seemed to support Trump’s election plans.

The new charges now describe Trump as a candidate running for office, rather than acting as President, to match the Supreme Court’s view.

Next Steps

As the legal fight continues, the judge overseeing the case has asked both sides to come up with a plan for moving forward. “The Justice Department says Trump doesn’t need to be in court in D.C. in person to respond to the new charges; his lawyers can do that for him.”

The upcoming November election makes things more complicated. If Trump wins, he could legally tell the Justice Department to drop the case against him, based on the powers the Supreme Court says a President has.

If Trump loses, the legal case will become even more important. Quick legal moves and possibly adding new defendants, like Rudy Giuliani and John Eastman, are key factors as the case moves ahead.

Wider Effects

The Special Council is working on other cases too.

Just yesterday, Smith’s team appealed a decision that threw out a separate case against Trump about classified documents. “Prosecutors say that Judge Cannon was wrong about the law,” referring to Judge Aileen Cannon’s decision to dismiss the case.

This appeal will continue alongside other ongoing investigations and legal actions, which will stay active through the election period.
